HomeScore Terms of Use

These terms describe the rules for using HomeScore, a buyer decision-support and realtor collaboration product powered by Confident Buying.

1. Decision Support Only

These terms govern the HomeScore mobile application, HomeScore web app, and HomeScore-related services. The general ConfidentBuying website Terms of Use are available at /terms-of-use.html. HomeScore helps buyers organize priorities, compare homes, capture tour notes, and understand buyer-fit signals. HomeScore does not provide financial, legal, tax, inspection, appraisal, lending, insurance, brokerage, or investment advice.

2. No Guarantee

Scores, rankings, recommendations, notes, and AI-assisted summaries are informational tools only. They do not guarantee a property's value, condition, availability, financing fit, resale potential, neighborhood fit, legal status, flood risk, insurance cost, or suitability for a particular buyer.

3. AI-Assisted Features

HomeScore may use AI-assisted features to summarize user input, suggest follow-up questions, organize notes, or help explain scoring signals. AI outputs may be incomplete, inaccurate, outdated, or inconsistent. Users and realtors should review AI-assisted content carefully and should not rely on it as a substitute for professional judgment, property verification, legal advice, financial advice, inspection, appraisal, lending guidance, or brokerage advice.

4. Realtor and Client Use

Realtors may invite clients, assign homes, review client priorities, and track follow-up questions. Realtors are responsible for their own licensing obligations, client communications, advertising rules, fair-housing compliance, MLS/IDX obligations, and professional duties.

5. Buyer Representation and Texas Brokerage Disclosures

Using HomeScore, receiving an invite, saving a home, or requesting information does not automatically create an agency, brokerage, fiduciary, or representation relationship. In Texas, a written buyer representation agreement may be required before touring homes or receiving certain buyer representation services. Daniel Nolan or Inc Realty, PLLC may provide required brokerage disclosures and representation documents before those services begin.

6. User Responsibilities

  • Use accurate information and keep login credentials secure.
  • Verify listing facts, prices, fees, schools, taxes, flood information, HOA details, restrictions, and property condition through trusted professionals and official sources.
  • Do not upload unlawful, misleading, discriminatory, confidential, or third-party content that you do not have the right to use.
  • Do not scrape, copy, redistribute, or misuse MLS, IDX, broker, agent, property, or photo data shown in HomeScore.

7. Account Access and Termination

Confident Buying may limit, suspend, or terminate access if an account violates these terms, creates security risk, misuses listing data, or interferes with the service. Users may delete their account through the in-app deletion flow.

8. Third-Party Services and Listing Data

HomeScore may rely on service providers for hosting, app distribution, database storage, authentication, listing search, and related operations. Listing data remains subject to the applicable MLS, IDX, broker, agent, public-record, or data-provider terms.

9. Equal Housing Opportunity

HomeScore supports and complies with fair housing laws and Equal Housing Opportunity requirements. Users and realtors may not use HomeScore profiles, notes, scores, AI-assisted outputs, property comparisons, or client communications to request, encourage, record, or make housing decisions based on protected characteristics or in violation of applicable fair housing laws.

10. Disclaimer of Warranties and Limitation of Liability

HomeScore is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Confident Buying, Daniel Nolan, Inc Realty, PLLC, and their service providers will not be liable for damages arising out of or related to use of HomeScore, scoring outputs, AI-assisted content, listing data, user notes, or inability to use the service.

11. Governing Law and Disputes

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from or related to HomeScore will be handled in Texas unless applicable law requires otherwise. Users agree to bring claims only in their individual capacity and not as a plaintiff or class member in a class, consolidated, or representative action.

13. Changes to These Terms

Confident Buying may update these terms from time to time by posting an updated version on this page.
